This Privacy Notice has been prepared under Article 10 of the Turkish Law No. 6698 on the Protection of Personal Data (“KVKK”) and the Communiqué on the Procedures and Principles to be Followed in Fulfilling the Obligation to Inform, in order to inform you about the personal data processed through the Arcadia Forma website, the project form on the website, and the email and telephone contact channels shown on the website.
1. Data controller
The data controller under the KVKK is Uga Group İnternational E-ticaret Limited Şirketi (the “Company”). Arcadia Forma is a brand operating within the Company; this website is operated by the Company under the Arcadia Forma brand.

2. Categories of personal data processed
The website has no membership or account registration. The personal data processed is limited to the information you send us as part of your own enquiry and to the connection data generated while the website is technically delivered:
- Identity data: the first name and surname you enter in the “Full name” field of the project form.
- Contact data: the email address you enter in the form’s “Email” field; if you contact us directly by email or telephone, your email address or telephone number.
- Request data: the subject you select in the form (Construction, Renovation, Project Management, Real Estate Development, Collaboration), the content you write in the “Message” field, and the content of any request you send by email or telephone.
- Transaction security data: connection data such as IP address, browser and device information, and the date and time of the request, technically processed by the infrastructure that hosts the website and processes the form when you visit the website and submit the form.
The “Message” field is free text. Please share only the information needed for your request in this field, and do not share special categories of personal data such as health, religion or ethnic origin. The website contains no analytics, advertising or marketing tracking tools.
3. Purposes of processing
- Receiving and assessing the requests, questions and collaboration proposals you send through the project form, email or telephone, and responding to you;
- Where your request relates to a project or service, conducting the related preliminary discussion and assessment process;
- Technically delivering the website and the project form, ensuring their security and identifying unwanted (spam) submissions;
- Fulfilling obligations arising from legislation and responding to lawful requests from authorised public institutions and organisations.
No newsletter subscription or marketing permission is collected through the website.
4. Method of collection and legal grounds
Your personal data is collected electronically — partly by automated means in the case of the form — when you yourself provide it by completing the project form, sending us an email or calling us. Transaction security data is generated by automated means while you visit the website.
This data is processed on the following legal grounds set out in Article 5(2) of the KVKK:
- Paragraph (c) — processing is necessary, provided that it is directly related to the establishment or performance of a contract, for the personal data of the parties to the contract: where your request is aimed at establishing a project or service relationship;
- Paragraph (f) — processing is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject: for responding to general questions and collaboration requests and for ensuring the security of the website and the form;
- Paragraph (ç) — processing is necessary for the data controller to fulfil its legal obligations: in respect of obligations arising from legislation.
Submitting the project form does not constitute a declaration of explicit consent; the processing described above is not based on explicit consent.
5. Recipient groups and purposes of transfer
Your personal data may be transferred, limited to the purposes above, to the following recipient groups:
- Hosting and form infrastructure provider: The website is published on the infrastructure of Netlify, Inc., which is headquartered in the USA. The information you send through the project form is received and stored by the Netlify Forms service; connection data is also processed by this infrastructure while the website is delivered. The purpose of the transfer is to ensure the technical operation of the website and the form.
- Font service: The fonts used on the website are loaded through the Google Fonts service. In doing so, your browser connects directly to Google servers and your IP address and browser information are transmitted to Google. The purpose of the transfer is to display the fonts used in the website’s design.
- Authorised public institutions and organisations: where required by legislation and to the extent requested.
Because Netlify and Google services may be provided through servers located outside Türkiye, your personal data may be processed outside Türkiye; this may constitute a transfer abroad within the scope of Article 9 of the KVKK. You may send requests for information about transfers abroad and their legal basis through the application channels below.
6. Retention period
Your personal data is retained for the period required by the purpose of processing and for the periods set out in the applicable legislation. When these periods end, it is erased, destroyed or anonymised in accordance with Article 7 of the KVKK and the Regulation on the Erasure, Destruction or Anonymisation of Personal Data.
7. Your rights as a data subject
Under Article 11 of the KVKK, by applying to the data controller you have the right to:
- learn whether your personal data is processed,
- request information if your personal data has been processed,
- learn the purpose of processing and whether the data is used in line with that purpose,
- know the third parties in Türkiye or abroad to whom your personal data is transferred,
- request the correction of your personal data if it is incomplete or inaccurate,
- request the erasure or destruction of your personal data within the framework of the conditions set out in Article 7 of the KVKK,
- request that the correction, erasure or destruction be notified to the third parties to whom your personal data has been transferred,
- object to a result against you arising from the analysis of the processed data exclusively through automated systems,
- claim compensation for damage you suffer due to the unlawful processing of your personal data.
8. How to apply
You may send requests concerning your rights, in accordance with the Communiqué on the Procedures and Principles for Applications to the Data Controller, by the following methods:
- in writing with a wet signature to our address stated above;
- signed with a secure electronic signature or mobile signature, to projects@arcadiaforma.com;
- from an email address you have previously notified to us and that is registered in our system, to projects@arcadiaforma.com.
Your application should include your name and surname, your signature if the application is in writing, your Turkish identity number for citizens of the Republic of Türkiye (for foreign nationals, your nationality, passport number or, if any, identity number), your residential or business address for notification, your email address for notification (if any), your telephone number and the subject of your request.
Your application will be concluded free of charge as soon as possible according to the nature of the request and within thirty days at the latest. If the process requires an additional cost, a fee may be charged according to the tariff set by the Personal Data Protection Board. If your application is rejected, you find the response insufficient, or no response is given in time, you may file a complaint with the Personal Data Protection Board under Article 14 of the KVKK.
